Requesting an opinion on a fuel storage facility project

To request the opinion of the National Authority for Emergency Services and Civil Protection (ANEPC) on:

  • projects for building or modifying storage facilities for petroleum products;
  • projects for building or modifying liquid and gaseous fuel supply facilities (filling stations).

You must attach the following documents to the form:

  • description of the project;
  • topographic map with a scale of 1:10 000, or other suitable map showing the location of the facility;
  • general plan of the facility on a scale of no less than 1:1 000, precisely defining the limits and boundaries within a 100-metre band. The plan must identify at least the streets and, within a 50-metre strip of the facility, the buildings that are inhabited, occupied or are open to members of the public;
  • floor plans, elevations and cross-sections, on a scale of no less than 1:100, that fully delineate the facility and identify all its relevant elements (namely tanks, piping, valves, supply units, vents and gas recovery system, drains and waste water treatment systems, as applicable);
  • procedural diagram for the facility as referred to in Annex I to Decree-Law No 267/2002 or when requested by the licensing body.

  1. click on ‘Access the service’on this page;
  2. sign in;
  3. fill in the form ‘Opinion on a fuel storage facility project’;
  4. click on ‘Submeter’ [‘Submit’].

Examination of the request

  • Once the request has been submitted, the form and documentation will be examined by the ANEPC.
  • If, during the technical examination, it is found that the requester needs to correct the request, provide further information or attach documents, they will be contacted to do so within a time frame of which they will be notified (never less than 10 working days). The period for deciding on the opinion is suspended until the deadline for the requester to submit what has been requested is given.
  • The ANEPC prepares a technical report along with the opinion.
  • The requester is notified of the opinion via the private area of the ePortugal portal and by email.

If the opinion is not favourable

  • If the opinion is not favourable, the requester will be invited to comment at a hearing of interested parties. The requester may be asked for additional documents or clarifications to enable the opinion to be modified. The applicant will be given a new time frame of at least 10 working days within which to provide the information requested.
  • After the end of the period for the hearing of interested parties, or the deadline for submitting new information, the applicant will be notified, via the private area of the ePortugal portal and by email, of the final decision and opinion.

Time of issue/decision

The ANEPC will issue a decision within 60 working days.

Reasons for refusal

  • Incorrectly completed request – failure to provide any form, document or other kind of information, submission of documents that are out of date or have expired and are considered essential for a favourable opinion.
  • Request submitted by unauthorised person (without the legal capacity to submit the request).
  • Non-compliance with the applicable laws, regulations and technical requirements – verified during the technical examination.
