Parental leave in Portugal

Initial parental leave

A woman must take 90 days of her leave after childbirth, and the remainder can be used, wholly or partially, before or after childbirth, making a total of 120 days paid at 100%. It is compulsory to take at least six weeks leave immediately after childbirth. 

The father is entitled to 20 mandatory business days leave after the birth of his child. The first five days are to be taken immediately after the birth and the other 15 must be taken within six weeks (42 days) of the birth, whether or not they are taken consecutively. 

The father is also entitled to 5 optional business days, consecutive or not, taken at the same time as the mother.

After initial parental leave, parents may take an extended parental leave, for a period of three months each. Those extending the leave receive an extended parental allowance or an extended leave adoption allowance, worth 25% of reference pay.

The father also has the possibility to take leave of the same duration as the mother would be entitled to.

In the event of the couple opting for shared leave, the leave period is extended by a further 30 days, paid at 100%. The fact that the parents take initial shared leave does not prevent the father from taking the optional 5 business days leave.

Special leave for teenage mothers

When the mother, the father or both are under 18 years of age, it may be necessary for another person to assume the rights and duties related to the child and his/her property (parental responsibility). 

In these cases, the Public Prosecutor's Office of the Family and Minors Court of the local district should be contacted.

Grandchildcare allowance

When one parent is under 16, working grandparents living with the baby are entitled to a leave for up to 30 continuous days after the birth. This leave can be shared by the grandparents.

The amount of the grandchild care allowance is 100% of the reference remuneration.
