Alcohol

You can check the obligations arising from the sale and consumption of alcoholic beverages in public places and in places open to the public.

The "Alcohol Law" is determined by Decreto-Lei n.º 50/2013, of April 16, amended by Decreto-Lei n.º 106/2015, of June 16, and the supervisory jurisdiction of this regime belongs to the ASAE, PSP and GNR, without prejudice to the supervisory powers attributed to other entities.

Decree-Law no. 50/2013, of April 16 - Establishes the regime of availability, sale and consumption of alcoholic beverages in public places and in places open to the public.

Decree-Law no. 106/2015, of June 16 - Proceeds to the first amendment to Decree-Law no. 50/2013, of April 16, which establishes the regime of availability, sale and consumption of alcoholic beverages in places open to the public.

Criteria and Obligations

This legislation provides for a prohibition on giving (regardless of commercial objectives), selling (for commercial purposes) or making available alcoholic beverages in public places and in places open to the public to:

  • The minors (Article 122 of the Civil Code provides that it is smaller who has not yet completed eighteen years of age);
  • Anyone who is notoriously intoxicated or seems to have a psychic anomaly.

These people can't consume alcoholic beverages in public places and in places open to the public. It may be required to present an identification document that allows proof of age, and this request should be made whenever there is any doubt about the age.

The provision, sale and consumption of alcoholic beverages in the following places is prohibited:

  • In canteens, bars and other establishments catering located in health facilities accessible to the public;
  • In automatic machines;
  • In fueling stations located on motorways or outside the localities, covering integrated buildings intended for activities complementary to the fuel supply, namely convenience stores, not including catering establishments or beverages.

The provision, sale and consumption of alcoholic beverages at any establishment between 0 and 8 hours is also prohibited, with the exception of:

  • Of establishments for catering or beverages, where a catering or beverage establishment is understood to be the purpose of providing, for remuneration, food, beverage and cafeteria services, either on or off the premises;
  • Of establishments located in ports and airports in an accessible place reserved for passengers;
  • Of nightlife and similar establishments.

In the establishment where alcoholic beverages are sold, the information on prohibitions on sale must be clearly visible on a printed notice and with the message written in easily legible characters and on a contrasting background.
