What are the documents and requirements to request the sharing of the couple’s assets?

  • You need to bring:

    • a list of the couple’s assets and the value of each one
    • an agreement on the way you wish to divide the assets
    • a pre-nuptial agreement certificate, if the pre-nuptial agreement was carried out in a registry office and the property scheme chosen is not part of the marriage registry.

How request the sharing of the couple’s assets?

To share the assets simultaneously with the divorce process, consult the page on the divorce by mutual consent.

To share the assets after the divorce or the separation of the people and assets, do the following:

  1. Both or one member of the couple (or their representative(s)) must go to a prior meeting at a Desk for Divorce with Sharing and bring the necessary documents.
  2. According to the complexity of the issues to be processed, the registry office schedules a day for the sharing, in which both members of the couple must be present (or their representative(s)).
  3. Up to two business days before the date of sharing, the couple must submit all documents indicated by the registry office in the prior meeting. If the documents are not submitted, the registry office may reschedule the date of the sharing.

Simultaneously with the sharing of the assets, the couple may also:

  • pay the tax duties regarding the sharing
  • carry out the necessary registries
  • alter the tax residence
  • request the exemption from the Real Estate Transfer Municipal Tax (IMI) regarding the permanent residence
  • register or update the urban building in the matrix
  • enter mortgage agreements, aimed for the payment of returns, with credit institutions, with or without a mortgage and deposit.
