What are the documents and requirements to communicate your participation in auctions?

  • Documentos Caso seja um operador económico português com título de atividade, deverá preencher no formulário o campo relacionado com o número do título de atividade. Caso seja uma leiloeira, deverá preencher no formulário com o nome e Número de Identificação Fiscal (NIF) da empresa que realiza o leilão.

How can you communicate your participation in auctions?

Lenders or auctioneers are asked to communicate the date on which the auction is to be held 20 days in advance. 

The communication should be sent as follows:

  • Operators should enter their identification details on the website
  • Complete the form
  • Select the option ‘Hold an auction’
  • Fill in details of the company holding the auction
  • Communicate the dates, venue and address of the auction.

Grounds for refusal

Request/communication submitted after the deadline – Holding an auction without complying with the legal deadlines is a serious administrative offence.

Ways of challenging a decision / Complaints to the Ombudsman

Complaints

  • You can lodge a complaint with the department that issued the decision within 15 days of being notified of that decision.
  • The authority has 30 days to reply to your complaint. Should this involve a complaint required for procedural purposes, and where no decision has been made within the time limit, the operator submitting the complaint may employ suitable legal means to seek a favourable decision.

It should be noted that when the complaint is required for subsequent submission in an administrative court dispute, the effects of the decision issued are suspended.

In the case of an optional complaint, suspension shall only take effect if the competent body considers that its immediate enforcement would cause damage that is irreparable or difficult to redress for the operator submitting the complaint and if such a suspension would not cause greater harm to the public interest.

Obligations

Economic operators are required to have a licence for auctioning or lending activities.
