Terms and conditions of the Electronic Notifications

The Public Service for Electronic Notifications (SPNE), associated with the Unique Digital Address (MUD), is managed by the Administrative Modernization Agency, IP (AMA).

These terms and conditions of use may be altered at any time by AMA, IP, stipulating that the alterations shall come into force from the date of their online publication.

Use of this platform is subject to express acceptance of these terms and conditions of use and their amendments.

AMA's privacy policy is an integral part of these terms and conditions of use.

Copyright

SPNE, available in web format on the ePortugal portal and in App format in the stores, is owned by AMA, IP. 

All content, including any videos, graphics, text, images, drawings, music or sounds and any other information is the property of AMA, IP, or has been included with permission of the entities that legitimately hold the copyright on them.

The protection of copyright and industrial property rights over the content present in SPNE extends to all copies of part or all of the information contained therein.

Access and changes

The AMA, IP, as the managing body of the system that provides the public service of electronic notifications, does not have access to the content of the electronic notifications sent.

AMA, IP will make every effort to provide continuous access to the platform, however, this access may be suspended, limited or interrupted at any time regardless of the reason. Access to the application may be limited from time to time to allow recovery, maintenance or introduction of new features or services. AMA, IP will make every effort to recover access as soon as possible.

AMA, IP reserves the right to suspend, modify, add or remove part of the SPNE content and to establish restricted access areas.

Where the SPNE is technically insufficient or unavailable, notifications must be sent by any other legally prescribed means.

Trademarks

The platform and all its contents, including without limitation, articles, opinions, other texts, audios, videos, photographs, as well as, trademarks, logos, domain names, names and names present in SPNE, are covered by copyright or industrial property rights and, as such, are protected by the Code of Copyright and Related Rights and the Code of Industrial Property and may not be reproduced or appropriated in any way without written permission of the respective rights holders.

Cookies policy

SPNE uses cookies and other similar technologies with the aim of improving the performance and browsing experience of its users by, on the one hand, increasing the speed and efficiency of response and, on the other, eliminating the need to repeatedly enter the same information. Cookies used in SPNE only store generic information, such as the form or region/city of access, among others.

The policy on cookies and similar technologies is available for consultation on the AMA website.

All browsers allow the user to accept, refuse or delete cookies by changing the browser settings. In this regard, users can deactivate the use of cookies at any time by modifying their browser settings.

Civil liability

The information contained in the SPNE does not constitute advice or a suggestion, nor does it establish any contractual relationship of liability of AMA, IP.

The content of the notifications received in the SPNE reserved area and made available to each entity or company are the sole responsibility of the entities that issue them.

The AMA, IP, as the managing body of the system that makes the SPNE available, does not have access to the notifications sent or their content.

The user is responsible for the safekeeping and correct use of his personal information, as well as for any damage or injury caused to AMA, IP or third parties, resulting from the incorrect use, loss or theft of personal information.

SPNE may refer to access to other links under the terms set out in AMA's privacy policy.

Misuse

The use of SPNE content for illegal purposes or any other purpose which could be considered unworthy or abusive is prohibited. The creation or introduction of any type of virus or other code or program containing destructive or harmful properties is also prohibited.

Processing of data

AMA, IP is responsible for the collection and processing of personal data. AMA, IP complies with all applicable EU and national legal standards regarding data protection, privacy and information security.

AMA has appointed a Data Protection Officer who may be contacted at dpo@ama.pt or by registered letter with acknowledgement of receipt to Rua de Santa Marta, 55, 1150-294 Lisboa. 

AMA, IP as data controller:

  • Ensures that the processing of your personal data is carried out for the purposes for which it was collected or for purposes compatible with them;
  • collects, uses and retains only the personal data necessary for the purpose in question;
  • It does not transmit any personal data for commercial or advertising purposes;
  • It treats personal data for lawful purposes or for the provision of services at your request.

The computer system supporting the public service of electronic notifications associated with the unique digital address guarantees the security and privacy of the information, in accordance with the legislation in force on the protection of personal data and AMA's privacy policy.

What personal data is collected by this platform?

First name and surname or company name, e-mail, NIC or NIF, date of birth, mobile phone number (optional) and professional attributes, if you have previously subscribed to SCAP.

All platform data is stored and processed in data centres located in Portugal.

Purpose of collection

Sending of notifications by e-mail and SMS by the entities participating in this form of notification, communication of new entities participating, as well as statistical analysis of navigation and use of the website.

What do we do whit personal data

Personal data is used for:

  • Subscribing to the SPNE;
  • Log in to the SPNE;
  • Sending notifications;
  • Notifying new members;
  • Generating proof of notification at the user's request.

With wich entities we share the data (all or part)

The personal data collected is not shared with any entity.

Storage period of personal data

Personal data are kept for the duration of the portal's operation.

The activity log of all notifications sent, with the date, time, subject and participating entity that sent the electronic notification, for a period of 15 years.

The notification signed electronically, guaranteeing its authenticity and suitability, is kept on the platform for a period of two years.

After the cancellation of the subscription and provided that the citizen does not request its deletion, the data will be kept in accordance with the above deadlines.

Security measures for processing personal data

The public service of electronic notifications only informs the adhering entities of the recipients of the notifications that have joined the public service of electronic notifications, and in no case provides their unique digital addresses.

The correspondence between the data of the person to be notified, known to the participating entity, and the data necessary to make the notifications available is guaranteed through the mechanism of identity federation, which safeguards the confidentiality of the data by encrypting the data ensuring that only the notifying entity and the notified party have access to the data collected.

The content of the electronic notifications circulates on the public service encrypted electronic notification platform ensuring that the entity managing the system does not have access to the content of the electronic notifications sent.

Modification and development of terms and conditions of use

These terms and conditions of use (TCU) may be changed at any time, without notice, depending on changes in the platform, regulatory or for reasons deemed necessary by the AMA.

Whenever these TCUs are changed, users will be notified at the next access to the electronic notification service and will be asked again for their acceptance.

Applicable law

The use of MUD and SPNE is governed by Portuguese law and the present TCU will be interpreted in accordance with Portuguese law.
