Register a trademark On the Spot

With this service you can get a trademark, from a pre-approved list, and start using it immediately. You can get just the trademark or also the company name. Choose the trademark and company name from a list of company names and trademarks already approved and available for purchase.

The trademarks available have already gone through the entire analysis and registry process by the Portuguese National Institute of Industrial Property (INPI). When you get a trademark, you can use it at once.

You can register the trademark at any “On the Spot Firm” service desk, available throughout the country or online, at the Empresa Online.

How can you Register a trademark On the Spot?

Follow the steps:

  3. Identify subclass of Services/ products
  4. Make payment
  5. Receive payment proof.

On the Spot Trademark services online only provides trademarks to categories of goods and services with the most demand in Portugal:

  • class 25  clothing, footwear and headgear
  • class 33  alcoholic beverages (except beer)
  • class 35  advertising, business management, business administration, office functions, sales promotion to thirds, retail or wholesale
  • class 36  insurance, financial affairs, monetary affairs, real estate affairs, property management, financial sponsorship, mediation service in purchase and sale of property
  • class 37  Building construction, repair, installation services
  • class 41  education, training, entertainment, sporting and cultural activities
  • class 43  catering services, temporary accommodation.

How much does it cost to register a trademark on the spot?

A trademark with one class of products or services costs 200 EUR at any “On the Spot Firm” service desks or 100 EUR when requested online. Each additional class costs 44 EUR.

TO GET THE ON SPOT TRADEMARK DO I NEED TO START A COMPANY?

No. Any person or entity can get a trademark, despite not wanting to incorporate an On the Spot Firm. If your entity is not established or based in Portugal, you will need a representative established or based in Portugal.

You can incorporate an On the Spot Firm with a trademark associated even if the object of the company is not the products for which you are getting the trademark (e.g. setting up a computer company with an associated trademark for clothing).

If you incorporate an On the Spot Firm with a trademark associated and want to change the company’s name, you can. The company name and the trademark are independent.

IS THE TRADEMARK MINE FOREVER?

The trademark is valid for 10 years.

You can renew the registry as often as you like, during the last six months of the trademark’s validity, as long as you meet the requirements for trademark maintenance.

DOES THE REGISTRY PROTECT MY TRADEMARK OUTSIDE PORTUGAL?

Registry only guarantees protection in Portugal

To register the trademark outside Portugal you can request the registry:

  • directly in the countries where you want to register the trademark
  • to the European Union
  • internationally.
