Plant Protection Measures - Communication of cessation of activity

Economic operators with activities related to the production and commercialisation/import of propagating and planting material for fruit, vegetable, ornamental and viticultural species must notify the total or partial cessation of their activity within 30 days of the cessation.
Economic operators whose activity is subject to the conditions for controlling the pine wood nematode (PWN) must also report the cessation of their activity, as must all other professional operators who carry out the activities provided for in Article 65(1) of EU Regulation 2016/2031 in Portugal.

To notify the total cessation of activity, you must have the Declaration of Cessation of Activity filed with the Tax and Customs Authority.

Procedure

You must report the cessation of activity within 30 days of its occurrence. 
To make the notification, follow these steps:

  1.  Access your reserved area on the CERTIGES platform
  2. Select the activity for which you wish to report the termination, indicating the reason and the date on which the activity ceased.
  3. Submit the form.

The DRAP/DRA/ICNF/IFCN in your area receives the communication and sends it to the DGAV for validation.
Once the DGAV has validated the communication, this information is available for consultation on the CERTIGES platform. 
The DRAP/DRA, the ICNF, the IFCN or the DGAV may request other documents that are necessary to assess and analyse your application.

Time of issue/decision

There isn’t a fixed deadline for the responsible authority’s validation.

Decree-Law no. 67/2020 of 15 September - Ensures the implementation and guarantees compliance with the obligations arising from Regulation (EU) no. 2016/2031 on protective measures against plant pests and Regulation (EU) no. 2017/625 on official controls in the field of protective measures against plant pests.
Decree-Law no. 82/2017 of 18 July, in its current wording - Establishes the legal regime for fruit trees and creates the National Register of Fruit Varieties, transposing Commission Implementing Directives no. 2014/96/EU, 2014/97/EU and 2014/98/EU. With regard to horticultural plants, it transposes Commission Directives 93/61/EEC and 93/62/EEC.
Decree-Law no. 237/2000, of 26 September, in its current wording - Applicable to the production and marketing of propagating material for ornamental plants as well as to the production and marketing of propagating material whose products are not intended for ornamental purposes, provided they are not covered by separate legislation.
Decree-Law no. 194/2006, of 27 September, in its current wording - Regulates the production, control, certification and marketing of grapevine vegetative propagation material.
Decree-Law no. 95/2011, of 8 August, amended and republished by Decree-Law no. 123/2015, of 3 July - Establishes extraordinary phytosanitary protection measures essential for the control of the pine wood nematode (PWN).
